Contractor Certification – Knowledge Compendium

We are pleased to present the latest edition of our study on the contractor certification system in public procurement. Prepared by a team of Andersen experts, this compendium provides a detailed overview of the key principles, procedures, and practical implications of the Contractor Certification Act, covering grounds for exclusion, conditions for participation, and mechanisms for verifying the validity of certificates. The publication also provides a detailed discussion of the self-cleaning procedure and the new obligations of certifying entities.

Certification in European practice.

In this issue, we encourage you to read an analysis of the functioning of contractor verification systems in other European markets. We discuss the experiences of countries using solutions analogous to certification, drawing attention to the impact of these tools on the competitiveness of contractors, the administrative burden on contracting authorities, and the professionalization of the public procurement market. The comparison shows how the new Polish regulations fit in with European trends and what benefits they can bring to entrepreneurs.

Key aspects:

  • Contractor certification – The publication explains what a certificate of non-exclusion and a certificate of capacity are, which entities can issue them, and how long they remain valid.
  • Certification procedure – The stages of the procedure are described in detail: from submitting an application, through document verification, to the rules for refusal and the possibility of raising objections.
  • Scope of verification – The compendium presents which grounds for exclusion are mandatory and which are optional, and how a contractor determines the level of their technical, professional, economic, and financial capacity.
  • Certificate control – The rules for challenging a certificate, suspension and revocation procedures, as well as the impact of KIO and court rulings on its validity are indicated.
