European Partner Spotlights: Cyprus & Portugal

This month, we invite you to explore two European Partner’s Spotlights. Nick Tsilimidos (Andersen in Cyprus) puts light on the most significant employment law developments shaping the Cypriot market in 2025, including the statutory recognition of parallel employment, extended maternity leave entitlements, new notification obligations for employers, and attractive tax incentives for highly compensated employees relocating to Cyprus. 

José Mota Soares (Andersen in Portugal) provides a timely analysis of Portugal’s “Work XXI” draft labor reform, exploring proposed changes to individual working-time banks, dismissal rules, term employment contracts, and breastfeeding leave – reforms that have sparked a general strike and ongoing negotiations with social partners. 

Poland – key findings:

  • Mobbing – The Supreme Court confirmed that workplace conflict, even intense, does not constitute mobbing. For employer liability, persistent harassment, intimidation, or isolation must be demonstrated based on objective criteria. 
  • Residence procedures for foreigners – Poland is moving to fully digital residence applications via the MOS system, aiming to streamline procedures while retaining in-person requirements for identity verification, fingerprints, and signatures. 
  • Pay Transparency Directive – A draft bill implementing the EU directive will require all employers to create transparent pay structures based on gender-neutral criteria. Employers with 100+ employees will face periodic reporting obligations on gender pay gaps. 
  • Collective Bargaining Agreements Act – The President signed amendments enabling collective agreements to address AI use in the workplace, work-life balance, anti-mobbing procedures, and psychosocial risks, with electronic submission to the National Record.
